By accepting the terms of this form, you are entering into a Photography Service Contract by and between Paegen Kang, the photographer, and you, the client.
SERVICES: The photographer will provide the service of the client's choice. Services include solo portraits, group portraits, event documentation, and film add-ons. Details are unique to each and found under each service under “details.” The amount of time booked by the client includes any breaks, outfit change time, or traveling once the session has begun, so any time taken for this will be deducted from total shooting time. Traveling to/from the site location is not included in the session length and will not be deducted from the total time booked. There may be extra fees associated with travel though, so see details under PAYMENT & DEPOSIT. *Note-- for events, a separate contract will be made between client and photographer with specific details pertaining to the event type (i.e. proposal, wedding, party, etc.).
PAYMENT & DEPOSIT: The client will pay the quoted amount unique to the service they select to the photographer in the form of cash, Venmo, CashApp, or ApplePay. Payment must be received before photos will be exported and edited by the photographer. A deposit may be necessary. Any deposit and its amount will be determined by the photographer and paid by the client within one week of booking to hold their time slot. If deposit is deemed necessary, the photographer will relay deposit information within 24 hours of client booking. If the client requests a location more than 20 miles from the photographer, a fee of $0.75/mile will be charged. In the case of airfare or overnight accommodations, the client will instead pay a flat rate fee of $100/day as well as the total price of the travel and hotel expenses. *Note-- deposits are typically only necessary for events or unique session types. 
CANCELLATION/RESCHEDULING: In the event that either party must cancel, 24 hour notice must be given, in which case no further steps are necessary. If the photographer cancels with less than 24 hour notice, no payment from the client is necessary. Future discount may be offered. If the client cancels with less than 24 hour notice, an additional $50 deposit will be required for their next booking (if applicable). Rescheduling from either party also requires a minimum of 24 hour notice. The client must discuss specifics regarding last minute changes or rescheduling with the photographer as soon as they come up, and they can not always be accommodated by the photographer. When it comes to unique sessions where a deposit is paid, like major events, it will become non refundable starting at the 72 hour mark. If any major changes or rescheduling occurs within 72 hours of the session, the photographer may require a new deposit. Cancellation within 72 hours of the session will result in no refund of deposit. If the photographer cancels or needs to make any major event-changing alterations, deposit will be refunded and further action may be taken. 
ALBUM & PHOTO DELIVERY: The client will receive a full album of photos containing all deliverable images from the session. Album sizes vary, but generally the longer the session and the more prepared the client is, the more photos the client will receive. The album will be sent digitally in the form of an iCloud link. This link can be opened from any device as many times as the client would like, but does expire in 30 days. The photographer guarantees delivery of this album within 30 days of payment (unless in the case of a large event or altered session). The photographer will keep client files for up to 1 year after the session, and is not liable for any claims after this period. The client accepts that all photographs will be taken and edited at the photographer’s discretion based on the photographer’s experience and artistic view. If the client has special requests, they may discuss these with the photographer prior and can create a “shot list” of all shots that they require.
COPYRIGHT AND USAGE: All photos taken by the photographer will remain the property of the Photographer and may not be used, reproduced, or distributed without the Photographer’s written consent. The client may use the photographs for personal, non-commercial purposes. When posted online, citations or tagging of the photographer is appreciated, but not required. The photographer will own the copyright in all images created and may use the work for samples, advertising, social media, and self-promotion. Usage outside the bounds of this agreement will require the client’s consent. The client agrees that they will not alter any photographs that are posted on the internet.
CONTACT: The client may direct message on social media, send a message through the website, or email the photographer at any time. The photographer will establish a preferred method of communication with the client and keep in touch through that method from time of booking until delivery of photos. Per discretion of the photographer, exchanging of phone numbers with the client, allowing text messaging and phone calls may be utilized. The photographer will maintain a timely response. Phone calls or meetings must be scheduled between the photographer and client ahead of time and should not be constant or time-draining. If calls or meetings become excessive, extra charges may apply. *Note-- calls/meetings are especially necessary with events or incredibly personalized sessions. In-person consultations may be preferred or required depending on session type (ex. surprise proposal planning).
LIABILITY: It is the client's responsibility to take care of self, as well as any family/friends, animals, and children present. The photographer will not accept any responsibility due to any accident to self (client) or other guests. In the case of client-caused damage to property during the session, the client must cover any associated expenses. If a location requested by the client requires a reservation, the photographer will complete this, but if said location requires any specialty fees, the cost will be added to the client's bill.
